Legal & Compliance Disclaimer
⚖️ Core Compliance Disclaimer & Audit Scope
This audit report reflects automated testing against detectable WCAG 2.2 AA technical criteria as of the scan date. Automated scans test a subset of accessibility standards. This report is for technical remediation purposes only, does not constitute formal legal counsel, and does not guarantee immunity from third-party claims or litigation.
1. Automated Auditing vs. Legal Advice
Rogabot is a developer software platform and automated accessibility auditing tool designed to assist organizations in testing digital assets against technical benchmarks, including W3C WCAG 2.1 & 2.2 Level AA. Rogabot, its creators, contractors, and operators do not provide formal legal counsel, attorney representation, or legal opinions. Nothing contained in our software, reports, audit findings, or outreach materials constitutes legal advice or establishes an attorney-client relationship.
2. Scope & Limitations of Automated Testing
While automated testing algorithms detect up to 50% to 60% of all WCAG failure criteria (such as color contrast, missing image alt attributes, form labels, and ARIA markup), automated scans do not test 100% of WCAG success criteria. Comprehensive compliance requires pairing automated scans with human review:
- Contextual Accuracy: Subjective quality of alternative text descriptions requires human context.
- Keyboard & Assistive Flows: Complex keyboard navigation flows, custom screen reader interactions (e.g., JAWS, NVDA, VoiceOver), and multi-step transactional checkout processes require manual evaluation.
- Dynamic & Third-Party Content: Synchronized media, live captions, and embedded third-party iframe applications may not be fully evaluated by automated crawlers.
3. Point-in-Time Assessment & Verification
All audit reports, certificates, and compliance scores represent a point-in-time assessment strictly valid for the specific web page code rendered during the precise timestamp of the audit. Any subsequent code deployments, CMS changes, blog posts, product additions, or third-party script integrations after the scan timestamp are outside the scope of the completed audit.
4. No Guarantee of Litigation Immunity
Implementing Rogabot's automated audits and developer code fixes significantly reduces digital barrier exposure and establishes a proactive, documented record of compliance. However, no software platform or manual audit can guarantee 100% immunity from third-party lawsuits, serial plaintiff actions, or demand letters under the Americans with Disabilities Act (ADA Title III), California Unruh Civil Rights Act, Colorado HB 21-1110, or other civil rights statutes.
5. Client Remediation & Implementation Responsibility
The client and their designated web engineering team remain solely responsible for reviewing, implementing, and validating all recommended code fixes and publishing their customized Accessibility Statement.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Rogabot and its providers shall not be held liable for any statutory damages, legal fees, settlement costs, lost profits, or consequential damages arising from any past, present, or future third-party accessibility claims, demand letters, or litigation.
